Sexual Assault in Uber & Lyft Vehicles

These companies advertise safe rides, but sexual assault has been an ongoing issue in rideshare services for years. Uber’s first safety report in 2017 recorded 5,981 total reports of various types of sexual assault. Uber recently released another report covering data from 2019-2020.

According to Uber’s report and an investigation by CNN, Uber recorded 141 cases of rape in 2020 and 247 in 2019. The data also acknowledged that women are the most common victims of abuse (81%) compared to men (15%). On the other hand, Lyft’s most recent safety report in 2021 stated that there were 4,158 cases of sexual assault from 2017 to 2019.

These alarming statistics have caused many to question their safety while using rideshares, and Uber began implementing criminal background checks in 2018 to improve the quality of the drivers they hire.

But their efforts may be too little too late. If you’re a victim, you still deserve justice.

Reporting Sexual Assault in an Uber or Lyft

After you experience sexual assault, you should report it immediately. Even if you were not directly assaulted, report the driver anyway. Remember, sexually suggestive gestures or comments are still considered sexual harassment and could escalate to sexual abuse. Reporting the incident could help protect the next rider from abuse.

Filing a Report with Uber

If you were sexually assaulted in an Uber, you can file a safety report on the app. Simply select help, the trip where the incident occurred, and report the issue. Before you file the report, write down any details you can remember from the trip and explain precisely what happened.

Filing a Report with Lyft

To make a report through the Lyft app, navigate your ride history, select the ride where the sexual assault occurred, and report the driver. Lyft will then connect you with a chatbot where you can explain what happened. Once you’ve filed a report with the rideshare service, you should also report the incident to local law enforcement.

How Common is Sexual Assault in Uber & Lyft?

There is a wide range of sexual assaults. Just because you were not a rape victim doesn’t mean that you weren’t sexually harassed or abused in some way.

Staring awkwardly or making sexually suggestive gestures should be reported and considered sexual harassment. Further, even unsuccessful attempts at sexual assault, such as attempted rape, should be reported and treated just as seriously.

Sexual assault is broken down into five categories:

  • Non-consensual kissing of a sexual body part
  • Non-consensual kissing of a non-sexual body part
  • Attempted non-sexual penetration
  • Non-consensual touch of a sexual body part
  • Non-consensual sexual penetration

You might have also experienced other forms of sexual assault:

  • Sexually suggestive comments
  • Non-consensual exposure to pornographic material
  • Non-consensual sexual photos being taken of you, also known as upskirting
  • Sexually suggestive gestures

What Has Uber & Lyft Done to Combat this Issue?

Uber and Lyft have implemented features that help riders stay safe.

GPS data tracks your ride and ensures you stay on course. Both rideshare companies also have an in-app emergency button that contacts local authorities. Uber has taken this further by allowing riders to share their ride so friends and family can keep tabs on loved ones.

Given that most sexual assault victims in rideshares are predominantly female, Uber has info on their website about women’s safety and steps they’ve taken to prevent rideshare sexual assault.

How to Stay Safe from Sexual Assault in a Rideshare

You may have experienced sexual assault in a rideshare before or never been a victim. Whatever your case may be, you should follow these steps to protect yourself:

  • Pay Attention to the Driver’s Behavior – It’s vital that you closely observe your driver’s behavior. Rarely does sexual assault happen instantly. Most of the time, a driver may stare at you awkwardly, make sexually suggestive comments, or touch non-sexual parts of your body without your consent.
  • Never Take a Rideshare by Yourself – You should always stay with your group and never take a rideshare by yourself, especially if you’ve been out at a bar or club. Drivers may exploit your vulnerability and attempt to assault you sexually.
  • Confirm the Ride Details – Before entering the vehicle, ask the driver who they are picking up. Additionally, confirm the driver’s license plate, photo, and name.
  • Take Advantage of Safety Features – Use Uber and Lyft’s safety features to protect yourself. Share your ride with friends and family so they can follow your trip and ensure you’re safe.
  • Don’t Hesitate to End the Ride – If your driver makes you feel uncomfortable, it’s easy to pass it off as an awkward trip. You might not think that suggestive comments could turn into a physical attack. However, these cases can escalate quickly; you must listen to your gut. End the ride, call local authorities, or share your location with a friend immediately.

“Great service with employees… patient and explain everything in a way that is understandable to the people.”

What to Do if You Were Sexual Assaulted or Harassed in an Uber or Lyft

Sexual assault victims can take legal action against their attackers in two ways. First, you have the option to report your case to local authorities. They will investigate, and the state will decide whether to press charges. Once reported, you can also pursue a lawsuit against the at-fault party to recover damages for the injuries you sustained and the pain and suffering you endured.

Our Compassionate & Skilled Lawyers Can Help You

You might be unsure of what to do after your sexual assault incident. Our Uber and Lyft sexual assault attorneys will guide you through the legal process and assist you in the following ways:

Hold Uber & Lyft Accountable

Even if the driver committed sexual assault, Uber and Lyft could still share responsibility. For example, if a driver assaulted you and an investigation reveals that they had a criminal record, Uber or Lyft could be at fault for putting riders in danger.

Make Rideshare Services Safer

By reporting your incident and filing a lawsuit, you help bring the issue into the spotlight and effectuate change. Uber and Lyft have made changes and rolled out new features to keep riders safe. Taking action against rideshare services also ensures that drivers who commit sexual assault are deactivated to prevent them from harming others.

Recover Compensation for Your Damages

You may be entitled to monetary compensation for economic and non-economic damages after a rideshare sexual assault incident. Depending on the severity, you might require medical attention for any injuries, therapy for the trauma you endured, and other various losses. The amount of compensation you can expect will vary depending on your case. Your Lyft and Uber sexual assault attorney can assess your damages and ensure you’re compensated fairly.

Lawsuits Against Uber & Lyft

There have been several sexual assault lawsuits filed against Uber over the years in multiple states across the country.

  • One lawsuit involves 550 women who claimed to have been sexually assaulted by their Uber driver.
  • Another case involved a woman who filed a lawsuit against Uber for failing to protect her from abuse after filing several reports.
  • Several lawsuits have also been filed against Lyft for failing to protect riders from abusive drivers. These cases involve drivers taking riders back to their homes, groping, and other forms of sexual assault.
